  4. Buyer's Representations and Warranties. You will not transmit any defamatory, obscene, trade libelous, threatening or harassing language. - You understand that failure to abide by this Agreement may result in denial of access to this Web Site. - You acknowledge and agree that RUSH will be acting as your real estate agent for any transactions initiated via the RUSH Web Site and you agree to inform other agents, brokers and property owners with which RUSH has put you in contact of this relationship. - You agree that no joint venture, partnership, or employment relationship exists between you and RUSH as a result of this Agreement or use of this website. 

  5. Your Information. "Your Information" is defined as any information you provide to us or other users in the course of using this Web Site, including, but not limited to, any public message area or through any e-mail feature. You are solely responsible for Your Information, and we act as a passive conduit for your online distribution and publication of Your Information. RUSH will only use Your Information in accordance with our Privacy Policy. With regard to Your Information, you promise that: - You will not transmit to RUSH any information containing any viruses, Trojan horses, worms, time bombs, cancelbots or other computer programming routines that are intended to damage, detrimentally interfere with, surreptitiously intercept or expropriate any system, data or personal information. You will not spam RUSH's Web Site. - You will do nothing to incur liability for RUSH or cause RUSH to lose (in whole or in part) the services of RUSH's ISP's or other suppliers. - Your Information shall not violate any law, statute, ordinance or regulation. - Your Information shall not link to or include descriptions of goods or services that are prohibited under this Agreement or that you do not have a right to link to or include. 

  6. Compliance with Federal and State Civil Rights Acts. RUSH complies with state and federal civil rights laws, including the Fair Housing Act and the Americans with Disabilities Act. By using this Web Site you agree to comply with such acts and thus agree to avoid stating any preference based on race, color, national origin, religion, handicap or any other category. At other locations in this Web Site, RUSH may remind you not to include information that is potentially actionable under such laws.

  7. Right to Refuse Service. RUSH reserves the right to refuse service to anyone for any reason. 

  8. Choice of Law. THIS AGREEMENT IS GOVERNED BY THE LAWS OF THE STATE OF OHIO AND ANY APPLICABLE FEDERAL LAWS, WITHOUT GIVING EFFECT TO CONFLICT OF LAWS PRINCIPLES. ANY LEGAL ACTION OR PROCEEDING UNDER THIS AGREEMENT SHALL FIRST BE SUBJECT TO ARBITRATION. ANY DISPUTES BETWEEN BUYER AND BROKER AND/OR OWNER SHOULD BE HANDLED DIRECTLY BETWEEN BUYER AND BROKER AND/OR OWNER. ANY ARBITRATION SHALL TAKE PLACE IN TOLEDO,OHIO. ARBITRATION SHALL BE GOVERNED BY THE RULES OF THE AMERICAN ARBITRATION ASSOCIATION. ARBITRATION SHALL BE THE SOLE REMEDY AVAILABLE TO BUYERS UNDER THIS AGREEMENT. RUSH SHALL NOT BE LIABLE FOR PUNITIVE DAMAGES ARISING OUT OF OR RELATING TO THIS AGREEMENT UNDER ANY CIRCUMSTANCES WHATSOEVER. 9.) Severability. In the event that any provision of this Agreement is determined by a court to be invalid or otherwise unenforceable, such provision (or portion thereof) shall be enforced to the extent possible consistent with the stated intention of the parties, or, if incapable of such enforcement, shall be deemed to be deleted from this Agreement, while the remainder of this Agreement shall continue in full force and remain in effect according to its stated terms and conditions.

  9. WARNING:
    REAL ESTATE AGENTS AND BROKERS MAY NOT REGISTER OR REPRESENT THEMSELVES AS BUYERS OR SELLERS ON CRAIGARUSH.COM.  ANY REAL ESTATE AGENT OR BROKER VIOLATING THIS POLICY WILL BE IMMEDIATELY DELETED FROM THE CRAIGARUSH.COM PERSONAL PORTAL LIST, PROHIBITED FROM FUTURE USE OF THIS WEB SITE, AND WILL BE SUBJECT TO FURTHER LEGAL AND ADMINISTRATIVE ACTION.
